Chapter II: Procedure

In proceedings within his jurisdiction, the Deputy European Public Prosecutor shall conduct investigations in accordance with the provisions applicable to the investigation in flagrante delicto or the preliminary investigation and the provisions of the Customs Code.

When the Public Prosecutor relinquishes jurisdiction in favour of the European Public Prosecutor’s Office, investigations shall continue under Article 696-113 or, where applicable, of article 696-114. When the investigating judge issues an order relinquishing jurisdiction in favour of the European Public Prosecutor’s Office, investigations continue under the same Article 696-114.
