Article 698-9 of the French Code of Criminal Procedure

The trial courts mentioned in articles 697 and 697-5 may, if they find in their decision that publicity is likely to result in the disclosure of a national defence secret, order, by decision given in open court, that the proceedings be held in camera. Where proceedings have been ordered to be held in camera, this shall apply to the delivery of separate judgments that may be given on incidents or objections.

The decision on the merits is always handed down in open court.

Les juridictions de jugement mentionnées aux articles 697 et 697-5 peuvent, en constatant dans leur décision que la publicité risque d’entraîner la divulgation d’un secret de la défense nationale, ordonner, par décision rendue en audience publique, que les débats auront lieu à huis clos. Lorsque le huis clos a été ordonné, celui-ci s’applique au prononcé des jugements séparés qui peuvent intervenir sur des incidents ou exceptions.

La décision au fond est toujours prononcée en audience publique.
