Article 699 of the French General Tax Code

Exchanges relating to all or part of mines under concession or lease with a view to rationalising their exploitation and increasing their productivity benefit from the tax regime laid down by Article 708, provided that the exchange deed expressly states that it is made under the benefit of the provisions of decree no. 54-944 of 14 September 1954.

In accordance with the provisions of articles L. 143-1, L. 143-8 and L. 143-13 of the Mining Code, the exchanges provided for in the first paragraph may only be carried out after authorisation has been given by the Minister responsible for mines. This authorisation must specify that the transaction benefits from the exemption system set out in this article.

Article 699

Les échanges portant sur tout ou partie des mines concédées ou amodiées et effectués en vue de la rationalisation de leur exploitation et de l’accroissement de leur productivité bénéficient du régime fiscal édicté par l’article 708, à la condition que l’acte d’échange porte la mention expresse qu’il est fait sous le bénéfice des dispositions du décret n° 54-944 du 14 septembre 1954.

Conformément aux dispositions des articles L. 143-1, L. 143-8 et L. 143-13 du code minier, les échanges prévus au premier alinéa ne pourront être réalisés qu’après autorisation donnée par le ministre chargé des mines. Cette autorisation devra préciser que l’opération bénéficie du régime d’exonération fixé par le présent article.
