The public prosecutor at a judicial court other than that of Paris may, for the offences referred to in Article 705, request the investigating judge initially seised to relinquish jurisdiction in favour of the Paris investigating court. The parties are notified in advance and invited to make their observations by the investigating judge. The order is made eight days at the earliest and one month at the latest from this notification.
When the examining magistrate decides to relinquish jurisdiction, his order only takes effect from the five-day period provided for in Article 705-3; when an appeal is lodged pursuant to that same article, the examining magistrate remains seised until he is notified of the judgment of the Criminal Division of the Court of Cassation.
As soon as the order has become res judicata, the Public Prosecutor with territorial jurisdiction sends the case file to the Financial Public Prosecutor.
