Article 706-125 of the French Code of Criminal Procedure

In other cases, the Investigating Chamber issues a judgment declaring the person not criminally responsible on the grounds of mental disorder by which:

1° It declares that there are sufficient charges against the person for having committed the acts of which he or she is accused;

2° It declares the person not criminally responsible on account of a psychic or neuropsychic disorder that has abolished his or her discernment or control over his or her actions at the time of the acts;

3° If the civil party so requests, it rules on the person’s civil liability, in accordance with Article 414-3 of the Civil Code, and shall rule on claims for damages;

4° It shall, if appropriate, order one or more of the security measures provided for in Chapter III of this Title.

Dans les autres cas, la chambre de l’instruction rend un arrêt de déclaration d’irresponsabilité pénale pour cause de trouble mental par lequel :

1° Elle déclare qu’il existe des charges suffisantes contre la personne d’avoir commis les faits qui lui sont reprochés ;

2° Elle déclare la personne irresponsable pénalement en raison d’un trouble psychique ou neuropsychique ayant aboli son discernement ou le contrôle de ses actes au moment des faits ;

3° Si la partie civile le demande, elle se prononce sur la responsabilité civile de la personne, conformément à l’article 414-3 du code civil, et statue sur les demandes de dommages et intérêts ;

4° Elle prononce, s’il y a lieu, une ou plusieurs des mesures de sûreté prévues au chapitre III du présent titre.
