Article 706-16-2 of the French Code of Criminal Procedure

The civil court with jurisdiction pursuant to article L. 217-6 of the Code de l’organisation judiciaire may conduct or arrange for the conduct of any useful hearings and investigations, without being able to invoke professional confidentiality. In particular, it may obtain from the public prosecutor or investigating judge a copy of the reports recording the offence or any other document relating to the criminal proceedings, including those in progress.
It may also request:

1° from any person or administration to provide information on the professional, financial, tax or social situation of persons liable for the damage caused by the offence or of the applicant;

2° From any administration or any State department, public authority, social security body, body responsible for administering social benefits or insurance company likely to compensate for all or part of the loss, the communication of information relating to the fulfilment of any of its obligations.
The information gathered in this way may not be used for any purpose other than investigating the claim for compensation and its disclosure is prohibited.

Article 706-16-2

La juridiction civile compétente en application de l’article L. 217-6 du code de l’organisation judiciaire peut procéder ou faire procéder à toutes auditions et investigations utiles, sans que puisse lui être opposé le secret professionnel. Elle peut notamment se faire communiquer, par le procureur de la République ou le juge d’instruction, copie des procès-verbaux constatant l’infraction ou de toute autre pièce de la procédure pénale, même en cours.


Elle peut également requérir :


1° De toute personne ou administration la communication de renseignements sur la situation professionnelle, financière, fiscale ou sociale des personnes ayant à répondre du dommage causé par l’infraction ou du requérant ;


2° De toute administration ou tout service de l’Etat, collectivité publique, organisme de sécurité sociale, organisme assurant la gestion des prestations sociales ou entreprise d’assurance susceptible de réparer tout ou partie du préjudice la communication des renseignements relatifs à l’exécution de ses obligations éventuelles.


Les renseignements ainsi recueillis ne peuvent être utilisés à d’autres fins que l’instruction de la demande d’indemnité et leur divulgation est interdite.
