The public prosecutor at a judicial court other than that of Paris may, for offences falling within the scope of Article 706-16, request the investigating judge to relinquish jurisdiction in favour of the Paris investigating court. The parties shall be notified in advance and invited to make their observations by the investigating judge; the order shall be made eight days at the earliest and one month at the latest from this notification.
The order by which the examining magistrate relinquishes jurisdiction does not take effect until the five-day period provided for in Article 706-22 has elapsed; where an appeal is lodged pursuant to that Article, the examining magistrate remains seised until the judgment of the Criminal Division of the Court of Cassation is brought to his attention.
As soon as the order has become final, the anti-terrorist public prosecutor sends the case file to the Paris public prosecutor.
The provisions of this article shall apply before the Investigating Chamber.
