When they concern one or more of the offences mentioned in articles 421-1 to 421-6 of the Penal Code as well as the offences mentioned in articles L. 224-1 et L. 225-7 of the Internal Security Code, information relating to the identity as well as the address or successive addresses of the home and, where applicable, residences of persons who have been the subject of :
1° A conviction, even if not yet final, including a conviction in absentia or a conviction with a dispensation or deferment of sentence;
2° A decision, even if not yet final, imposing an educational measure, a dispensation from an educational measure or a declaration of educational success on a minor pursuant to Title I of Book I of the code de la justice pénale des mineurs;
3° D’une décision d’irresponsabilité pénale pour cause de trouble mental ;
4° A decision of the same nature as those mentioned in 1° to 3° handed down by foreign courts or judicial authorities which, pursuant to an international convention or agreement, have been notified to the French authorities or have been enforced in France following the transfer of sentenced persons;
5° An indictment.
The file also includes information relating to the judicial decision that justified registration and the nature of the offence. The decisions mentioned in 1° to 3° are recorded as soon as they are handed down.
The decisions mentioned in 1°, 3° and 5° are automatically recorded in the file, unless the competent court decides otherwise and gives specific reasons. The decisions referred to in 4° are also entered in the file as of right, unless the public prosecutor decides otherwise and gives special reasons.
Decisions concerning minors under the age of thirteen are not entered in the file. Decisions concerning minors between the ages of thirteen and eighteen shall not be entered in the file, unless such entry is ordered by express decision of the court or, in the cases provided for in the same 3° and 4°, of the public prosecutor.
