One of the future spouses who is unable to obtain this deed may make up for it by producing a notarised deed issued by a notary or, abroad, by the competent French diplomatic or consular authorities.
The acte de notoriété is drawn up on the basis of the statements of at least three witnesses and any other documents produced which attest to the forenames, surname, profession and place of residence of the future spouse and those of his or her father and mother if known, the place and, as far as possible, the time of birth and the causes which prevent the birth certificate from being produced. The notarial deed is signed by the notary or the diplomatic or consular authority and by the witnesses.
