Article 711 of the French Code of Criminal Procedure

The court or tribunal, at the request of the public prosecutor or the interested party, shall rule in chambers after hearing the public prosecutor, the party’s counsel if he so requests and, if appropriate, the party himself, subject to the provisions of l’article 712. Where the petitioner is detained, his appearance before the court shall be as of right only if he expressly so requests in his petition.

The execution of the decision in dispute shall be suspended if the court or tribunal so orders.

The judgment on the incident shall be served on the interested parties at the request of the public prosecutor.

If the parties agree, the decision may be made, without a hearing, by order of the president of the court.

Article 711

Le tribunal ou la cour, sur requête du ministère public ou de la partie intéressée, statue en chambre du conseil après avoir entendu le ministère public, le conseil de la partie s’il le demande et, s’il échet, la partie elle-même, sous réserve des dispositions de l’article 712. Lorsque le requérant est détenu, sa comparution devant la juridiction n’est de droit que s’il en fait la demande expresse dans sa requête.

L’exécution de la décision en litige est suspendue si le tribunal ou la cour l’ordonne.

Le jugement sur l’incident est signifié à la requête du ministère public aux parties intéressées.

En cas d’accord des parties, la décision peut être prise, sans audience, par ordonnance du président de la juridiction.
