Article 712-14 of the French Code of Criminal Procedure

The decisions of the enforcement judge and the enforcement court are provisionally enforceable. However, where the public prosecutor’s appeal is lodged within twenty-four hours of notification, it suspends enforcement of the decision until the enforcement division of the court of appeal or its president has ruled. The case must be heard no later than two months after the public prosecutor’s appeal, failing which the appeal is null and void.

Les décisions du juge de l’application des peines et du tribunal de l’application des peines sont exécutoires par provision. Toutefois, lorsque l’appel du ministère public est formé dans les vingt-quatre heures de la notification, il suspend l’exécution de la décision jusqu’à ce que la chambre de l’application des peines de la cour d’appel ou son président ait statué. L’affaire doit être examinée au plus tard dans les deux mois suivant l’appel du parquet, faute de quoi celui-ci est non avenu.
