Article 712-23 of the French Code of Criminal Procedure

A decree shall specify the conditions of application of the provisions of this chapter.

This decree specifies the conditions under which the expert opinion provided for by article 712-21 may not be ordered, with the agreement of the public prosecutor, either because of the existence in the convicted person’s file of a previous expert opinion, or, for persons convicted of offences for which it sets the list, in the event of a temporary leave or because of the personality of the person concerned, or in the event of the issue of the medical certificate referred to in the second sentence of the second paragraph of l’article 720-1-1.

Un décret précise les conditions d’application des dispositions du présent chapitre.

Ce décret précise les conditions dans lesquelles l’expertise prévue par l’article 712-21 peut ne pas être ordonnée, avec l’accord du procureur de la République, soit en raison de l’existence dans le dossier du condamné d’une précédente expertise, soit, pour les personnes condamnées pour des infractions dont il fixe la liste, en cas de permission de sortir ou en raison de la personnalité de l’intéressé, soit en cas de délivrance du certificat médical visé à la seconde phrase du deuxième alinéa de l’article 720-1-1.
