Article 713-11 of the French Code of Criminal Procedure

The Public Prosecutor’s Office of the court which ordered the confiscation of property shall immediately inform the competent authority of the executing State, by any means which leaves a written record, of any fact which has the effect of either depriving the order of its enforceability or removing its execution from the executing State, or of modifying the execution of the order.

Where the confiscation order has been partially enforced, the public prosecutor shall specify the amount or assets still to be recovered.

Le ministère public près la juridiction qui a ordonné la confiscation d’un bien informe immédiatement l’autorité compétente de l’Etat d’exécution, par tout moyen laissant une trace écrite, de tout ce qui a pour effet soit de retirer à la décision son caractère exécutoire ou de soustraire son exécution à l’Etat d’exécution, soit de modifier l’exécution de la décision.


Lorsque la décision de confiscation a été exécutée en partie, le ministère public précise le montant ou les biens restant à recouvrer.
