Article 713-22 of the French Code of Criminal Procedure

Enforcement of a confiscation order may be refused in any of the following cases:

1° If the confiscation order is based on criminal proceedings relating to offences committed in whole or in part within the territory of the Republic;

2° If the confiscation order is based on criminal proceedings relating to offences which were committed outside the territory of the issuing State and French law does not authorise the prosecution of these acts when committed outside the territory of the Republic.

L’exécution d’une décision de confiscation peut être refusée dans l’un des cas suivants :


1° Si la décision de confiscation est fondée sur une procédure pénale relative à des infractions commises en tout ou partie sur le territoire de la République ;


2° Si la décision de confiscation est fondée sur une procédure pénale relative à des infractions qui ont été commises hors du territoire de l’Etat d’émission et que la loi française n’autorise pas la poursuite de ces faits lorsqu’ils sont commis hors du territoire de la République.
