Article 713-32 of the French Code of Criminal Procedure

Property other than sums of money confiscated pursuant to the confiscation order may be sold in accordance with the provisions of the Code du domaine de l’Etat.

The sums of money recovered and the proceeds of the sale of confiscated property are vested in the French State when the amount recovered is less than €10,000, and half in the French State and half in the issuing State in other cases.

The costs of enforcing the confiscation order are not deducted from the amount allocated to the issuing State. However, where high or exceptional costs have had to be incurred, details of such costs may be communicated to the issuing State in order to obtain a share of them.

Confiscated property that is not sold devolves to the French State unless otherwise agreed with the issuing State.

Les biens autres que des sommes d’argent, confisqués en application de la décision de confiscation, peuvent être vendus selon les dispositions du code du domaine de l’Etat.

Les sommes d’argent recouvrées et le produit de la vente des biens confisqués sont dévolus à l’Etat français lorsque le montant recouvré est inférieur à 10 000 €, et dévolus pour moitié à l’Etat français et pour moitié à l’Etat d’émission dans les autres cas.

Les frais d’exécution de la décision de confiscation ne sont pas imputés sur le montant dévolu à l’Etat d’émission. Toutefois, lorsque des frais élevés ou exceptionnels ont dû être supportés, des indications détaillées sur ces frais peuvent être communiquées à l’Etat d’émission afin d’en obtenir le partage.

Les biens confisqués qui ne sont pas vendus sont dévolus à l’Etat français sauf accord contraire avec l’Etat d’émission.
