Article 713-35-1 of the French Code of Criminal Procedure

For the application of Regulation (EU) 2018/1805 of the European Parliament and of the Council of 14 November 2018 on the mutual recognition of freezing orders and confiscation orders, the competent authorities referred to in Articles 8 and 9 of Article 2 of the same Regulation are as follows:

1° The issuing authority for confiscation orders handed down by French courts is the public prosecutor’s office of the court that ordered the confiscation;

2° The enforcement authority for confiscation orders issued by the courts of another Member State of the European Union is the territorially competent criminal court, seised at the request of the public prosecutor. The territorially competent correctional court is that of the place where one of the confiscated assets is located or, failing that, the correctional court of Paris.

Pour l’application du règlement (UE) 2018/1805 du Parlement européen et du Conseil du 14 novembre 2018 concernant la reconnaissance mutuelle des décisions de gel et des décisions de confiscation, les autorités compétentes mentionnées aux 8 et 9 de l’article 2 du même règlement sont les suivantes :


1° L’autorité d’émission des décisions de confiscation prononcées par les juridictions françaises est le ministère public près la juridiction qui a ordonné la confiscation ;


2° L’autorité d’exécution des décisions de confiscation prononcées par les juridictions d’un autre Etat membre de l’Union européenne est le tribunal correctionnel territorialement compétent, saisi sur requête du procureur de la République. Le tribunal correctionnel territorialement compétent est celui du lieu où se situe l’un des biens confisqués ou, à défaut, le tribunal correctionnel de Paris.
