Article 713-38 of the French Code of Criminal Procedure

Enforcement of confiscation ordered by a foreign judicial authority pursuant to Article 713-36 is authorised by the criminal court, at the request of the public prosecutor.

Enforcement is authorised on condition that the foreign decision is final and enforceable under the law of the requesting State.

Authorisation of enforcement may not have the effect of prejudicing the rights lawfully constituted in favour of third parties, pursuant to French law, in respect of the property confiscated by the foreign decision. However, if this decision contains provisions relating to the rights of third parties, it is binding on the French courts unless the third parties have not been able to assert their rights before the foreign court under conditions similar to those provided for by French law.

Refusal to authorise enforcement of the confiscation order issued by the foreign court automatically entails release of the seizure. The same applies if the proceedings instituted abroad have ended or have not led to the confiscation of the seized assets.

L’exécution de la confiscation ordonnée par une autorité judiciaire étrangère en application de l’article 713-36 est autorisée par le tribunal correctionnel, sur requête du procureur de la République.

L’exécution est autorisée à la condition que la décision étrangère soit définitive et exécutoire selon la loi de l’Etat requérant.

L’autorisation d’exécution ne peut avoir pour effet de porter atteinte aux droits licitement constitués au profit des tiers, en application de la loi française, sur les biens dont la confiscation a été prononcée par la décision étrangère. Toutefois, si cette décision contient des dispositions relatives aux droits des tiers, elle s’impose aux juridictions françaises à moins que les tiers n’aient pas été mis à même de faire valoir leurs droits devant la juridiction étrangère dans des conditions analogues à celles prévues par la loi française.

Le refus d’autoriser l’exécution de la décision de confiscation prononcée par la juridiction étrangère emporte de plein droit mainlevée de la saisie. Il en est de même lorsque les poursuites engagées à l’étranger ont pris fin ou n’ont pas conduit à la confiscation des biens saisis.
