Article 713-4 of the French Code of Criminal Procedure

The confiscation order or certified copy thereof and the certificate shall, subject to the second subparagraph, be transmitted by the competent authority of the issuing State directly to the competent authority of the executing State by any means which leaves a written record under conditions allowing that authority to verify their authenticity.

Where a Member State of the European Union has made a declaration to this effect, the confiscation order or the certified copy thereof and the certificate shall be sent through one or more central authorities designated by that State.

At the request of the competent authority of the issuing State, the certified copy of the confiscation order and the original of the certificate shall be sent as soon as possible.

All communications shall be made directly between the competent authorities.

Article 713-4

La décision de confiscation ou la copie certifiée conforme de celle-ci et le certificat sont, sous réserve du deuxième alinéa, transmis par l’autorité compétente de l’Etat d’émission directement à l’autorité compétente de l’Etat d’exécution par tout moyen laissant une trace écrite et dans des conditions permettant à cette autorité d’en vérifier l’authenticité.

Lorsqu’un Etat membre de l’Union européenne a effectué une déclaration à cet effet, la décision de confiscation ou la copie certifiée conforme de celle-ci et le certificat sont expédiés par l’intermédiaire d’une ou plusieurs autorités centrales désignées par ledit Etat.

Sur demande de l’autorité compétente de l’Etat d’émission, la copie certifiée conforme de la décision de confiscation et l’original du certificat sont adressés dans les meilleurs délais.

Toutes les communications s’effectuent directement entre les autorités compétentes.
