The execution on the territory of the Republic of a confiscation order issued by a foreign court entails the transfer to the French State of ownership of the confiscated property, unless otherwise agreed with the requesting State.
Property thus confiscated may be sold in accordance with the provisions of the Code du domaine de l’Etat.
The costs of enforcing the confiscation order shall be deducted from the total amounts recovered.
The sums of money recovered and the proceeds of the sale of the confiscated property, less the costs of enforcement, shall devolve to the French State where this amount is less than €10,000 and shall devolve half to the French State and half to the requesting State in other cases.
If the foreign decision provides for value confiscation, the decision authorising its execution makes the French State a creditor with the obligation to pay the corresponding sum of money.Failing payment, the State has its claim recovered from any property available for this purpose. The amount recovered, after deduction of all costs, shall be shared in accordance with the rules set out in this article.
