Article 729-2 of the French Code of Criminal Procedure

When a foreign national sentenced to a custodial sentence is subject to a French ban, an administrative ban on French territory, an obligation to leave French territory, a ban on returning to French territory, a ban on movement on French territory, expulsion, extradition or surrender on the basis of a European arrest warrant, his conditional release is subject to the condition that this measure is carried out. It may be decided without his consent.

As an exception to the provisions of the previous paragraph, the sentence enforcement judge, or the sentence enforcement court, may also grant conditional release to a foreign national who is subject to a supplementary sentence of deportation from French territory by ordering the suspension of the execution of this sentence for the duration of the assistance and supervision measures provided for in l’article 732. At the end of this period, if the conditional release decision has not been revoked, the foreign national is automatically released from the French ban. Otherwise, the measure becomes enforceable again.

Article 729-2

Lorsqu’un étranger condamné à une peine privative de liberté est l’objet d’une mesure d’interdiction du territoire français, d’interdiction administrative du territoire français, d’obligation de quitter le territoire français, d’interdiction de retour sur le territoire français, d’interdiction de circulation sur le territoire français, d’expulsion, d’extradition ou de remise sur le fondement d’un mandat d’arrêt européen, sa libération conditionnelle est subordonnée à la condition que cette mesure soit exécutée. Elle peut être décidée sans son consentement.

Par exception aux dispositions de l’alinéa précédent, le juge de l’application des peines, ou le tribunal de l’application des peines, peut également accorder une libération conditionnelle à un étranger faisant l’objet d’une peine complémentaire d’interdiction du territoire français en ordonnant la suspension de l’exécution de cette peine pendant la durée des mesures d’assistance et de contrôle prévue à l’article 732. A l’issue de cette durée, si la décision de mise en liberté conditionnelle n’a pas été révoquée, l’étranger est relevé de plein droit de la mesure d’interdiction du territoire français. Dans le cas contraire, la mesure redevient exécutoire.
