When the person has been sentenced to a custodial sentence for one or more offences mentioned in articles 421-1 to 421-6 of the Criminal Code, excluding those defined in articles 421-2-5 to 421-2-5-2 of the same code, conditional release may only be granted:
1° By the sentence enforcement court, regardless of the length of the prison sentence still to be served;
2° After receiving the opinion of a commission responsible for carrying out a multidisciplinary assessment of the dangerousness of the convicted person.
The sentence enforcement court may oppose conditional release if such release is likely to cause a serious disturbance to public order.
A decree shall specify the conditions for the application of this article.
