The person subject to conditional release may be subject to the obligations set out for socio-judicial supervision if he or she has been convicted of a crime or offence for which this measure is incurred. Unless otherwise decided by the sentence enforcement judge or the sentence enforcement court, this person is subject to a treatment order under the conditions set out in articles L. 3711-1 et seq. of the Public Health Code if it is established, after the expert assessment provided for in Article 712-21 of this Code, that he or she is likely to undergo treatment.
A person sentenced to at least five years’ imprisonment for an offence for which socio-judicial monitoring is incurred may be placed under mobile electronic monitoring in accordance with the procedures set out in articles 763-12 and 763-13. The sentence enforcement court or the sentence enforcement judge, according to the distinctions in articles 730and 730-2, determines the period for which the sentenced person will actually be placed under mobile electronic surveillance. This period may not exceed two years, renewable once in the case of a misdemeanour and twice in the case of a felony.
