Article 731 of the French Code of Criminal Procedure

The granting of conditional release may be subject to special conditions as well as assistance and monitoring measures designed to facilitate and verify the rehabilitation of the released person. In particular, parolees may be subject to one or more of the supervision measures or obligations mentioned in articles 132-44 and 132-45 of the Penal Code.

These measures are implemented by the sentence enforcement judge assisted by the prison integration and probation service, and, where appropriate, with the assistance of organisations authorised for this purpose.

A decree shall determine the procedures for applying the measures referred to in this article and the conditions for authorising the organisations mentioned in the previous paragraph. It shall also lay down the terms and conditions of the funding essential for the application of these measures and the operation of the committees.

Article 731

Le bénéfice de la libération conditionnelle peut être assorti de conditions particulières ainsi que de mesures d’assistance et de contrôle destinées à faciliter et à vérifier le reclassement du libéré. Celui-ci peut en particulier être soumis à une ou plusieurs des mesures de contrôle ou obligations mentionnées aux articles 132-44 et 132-45 du code pénal.

Ces mesures sont mises en oeuvre par le juge de l’application des peines assisté du service pénitentiaire d’insertion et de probation, et, le cas échéant, avec le concours des organismes habilités à cet effet.

Un décret détermine les modalités d’application des mesures visées au présent article et les conditions d’habilitation des organismes mentionnés à l’alinéa précédent. Il fixe également les conditions du financement indispensable à l’application de ces mesures et au fonctionnement des comités.
