Article 742 of the French Code of Criminal Procedure

When the convicted offender does not comply with the supervision measures or special obligations imposed pursuant to article 739, when he has committed an offence followed by a conviction for which the revocation of the suspended sentence has not been ordered, the sentence enforcement judge may, of his own motion or at the request of the public prosecutor, order by reasoned judgment the extension of the probation period. He may also, under the conditions set out in articles 132-49 to 132-51 of the Penal Code, revoke all or part of the suspended sentence.

The decision is taken in accordance with the provisions of article 712-6.

These provisions apply even when the probation period set by the court has expired, when the reason for the extension of the period or the revocation occurred during the probation period.

Article 742

Lorsque le condamné ne se soumet pas aux mesures de contrôle ou aux obligations particulières imposées en application de l’article 739, lorsqu’il a commis une infraction suivie d’une condamnation à l’occasion de laquelle la révocation du sursis n’a pas été prononcée, le juge de l’application des peines peut, d’office ou sur réquisitions du parquet, ordonner par jugement motivé la prolongation du délai de probation. Il peut aussi, dans les conditions prévues aux articles 132-49 à 132-51 du code pénal, révoquer en totalité ou en partie le sursis.

La décision est prise conformément aux dispositions de l’article 712-6.

Ces dispositions sont applicables même lorsque le délai de probation fixé par la juridiction a expiré, lorsque le motif de la prolongation du délai ou de la révocation s’est produit pendant le délai de probation.
