The technical procedures used must guarantee, under conditions laid down by order of the Minister of Justice, the reliability of the identification of the parties to the electronic communication, the integrity of the documents sent, the security and confidentiality of the exchanges, the preservation of the transmissions made and make it possible to establish with certainty the date of sending and, that of making available or that of receipt by the recipient.
For the purposes of applying the provisions of this code to documents that the parties, the public prosecutor or the court officers assisting or representing the parties serve or hand over in the course of proceedings before the courts of the first and second instance, the identification carried out at the time of transmission by electronic means, in accordance with the procedures provided for in the first paragraph, shall be deemed to be a signature.
