Title XXI: Communication by electronic means.

The dispatch, delivery and notification of pleadings, documents, notices, warnings or summonses, reports, minutes and enforceable copies of court decisions may be effected by electronic means under the conditions and in accordance with the procedures laid down in this Title, without prejudice to any special provisions requiring the use of this means of communication.

The recipient of the mailings, deliveries and notifications referred to in Article 748-1 must expressly consent to the use of electronic means, unless special provisions require the use of this method of communication. Consent within the meaning of the preceding paragraph means membership by a court officer, assisting or representing a party, of an electronic communication network as defined by an order made pursuant to Article 748-6.

The dispatches, deliveries and notifications mentioned in Article 748-1 shall be the subject of an electronic notice of receipt sent by the addressee, which shall indicate the date and, where applicable, the time thereof. Where a document has been drawn up in the original on paper, the judge may require its production.

The use of electronic communication does not preclude the right of the interested party to request the delivery, on paper, of a copy of the court decision bearing the enforcement formula.

The technical procedures used must guarantee, under conditions laid down by order of the Minister of Justice, the reliability of the identification of the parties to the electronic communication, the integrity of the documents sent, the security and confidentiality of the exchanges, the preservation of the transmissions made and make it possible to establish with certainty the date of sending and, that of making available or that of receipt by…

Where a document must be completed before the expiry of a time limit and cannot be sent electronically on the last day of the time limit for reasons beyond the control of the person completing it, the time limit is extended until the next working day.
