Article 748-6 of the French Code of civil procedure

The technical procedures used must guarantee, under conditions laid down by order of the Minister of Justice, the reliability of the identification of the parties to the electronic communication, the integrity of the documents sent, the security and confidentiality of the exchanges, the preservation of the transmissions made and make it possible to establish with certainty the date of sending and, that of making available or that of receipt by the recipient.

For the purposes of applying the provisions of this code to documents that the parties, the public prosecutor or the court officers assisting or representing the parties serve or hand over in the course of proceedings before the courts of the first and second instance, the identification carried out at the time of transmission by electronic means, in accordance with the procedures provided for in the first paragraph, shall be deemed to be a signature.

Les procédés techniques utilisés doivent garantir, dans des conditions fixées par arrêté du garde des sceaux, ministre de la justice, la fiabilité de l’identification des parties à la communication électronique, l’intégrité des documents adressés, la sécurité et la confidentialité des échanges, la conservation des transmissions opérées et permettre d’établir de manière certaine la date d’envoi et, celle de la mise à disposition ou celle de la réception par le destinataire.

Vaut signature, pour l’application des dispositions du présent code aux actes que les parties, le ministère public ou les auxiliaires de justice assistant ou représentant les parties notifient ou remettent à l’occasion des procédures suivies devant les juridictions des premier et second degrés, l’identification réalisée, lors de la transmission par voie électronique, selon les modalités prévues au premier alinéa.
