Unless further information has been ordered, the President of the Enforcement Division shall rule within twenty days of the matter being referred to it by means of a reasoned order made in chambers.
If the President of the Enforcement Division deems it necessary to hear the sentenced person, Article 706-71 may be applied, whether the convicted person is living in French territory or abroad.
The President of the Enforcement Division may, by a measure of judicial administration, authorise the sentencing State to intervene at the hearing through a person authorised by that same State for this purpose. Where the sentencing State is authorised to intervene, it shall not become a party to the proceedings.
When the president of the enforcement chamber considers raising one of the grounds for refusal provided for in 1° to 3°, 8° and 9° of Article 764-24 and in article 764-25, there is no need to inform the competent authority of the sentencing State if this information has already been provided by the enforcement judge pursuant to Article 764-23.
