The sentence enforcement judge is also competent to issue a reasoned judgment, under the conditions provided for in article 712-6, revocation of conditional release or suspension of enforcement of the sentence and to impose the custodial sentence or measure involving deprivation of liberty provided for in the conviction or the probation decision issued by the authorities of the sentencing Member State, in the case of an alternative sanction.

Where a person has been sentenced to an alternative penalty and the sentence does not include a custodial penalty or measure involving deprivation of liberty to be enforced in the event of non-compliance with that penalty, the enforcement judge shall notify the public prosecutor in the event of non-compliance with the obligations or injunctions mentioned in the alternative penalty so that the latter can assess the action to be taken in the light of Articles 434-38 et seq. of the Criminal Code.

Where such non-compliance with the alternative penalty does not constitute a criminal offence under French law, the public prosecutor will inform the competent authority of the sentencing State of these facts and of the impossibility for the French judicial authorities to rule on the case.

Le juge de l’application des peines est également compétent pour prononcer par jugement motivé, dans les conditions prévues à l’article 712-6, la révocation de la libération conditionnelle ou du sursis à l’exécution de la condamnation et pour prononcer la peine ou la mesure privative de liberté prévue par la condamnation ou la décision de probation rendue par les autorités de l’Etat membre de condamnation, en cas de peine de substitution.

Lorsqu’une personne a été condamnée à une peine de substitution et que la condamnation ne comporte pas de peine ou de mesure privative de liberté devant être exécutée en cas de non-respect de cette peine, le juge de l’application des peines avise le procureur de la République en cas de non-respect des obligations ou des injonctions mentionnées dans la peine de substitution pour que celui-ci apprécie la suite à donner au regard des articles 434-38 et suivants du code pénal.

Lorsque ce non-respect de la peine de substitution n’est pas constitutif d’une infraction pénale au regard de la législation française, le procureur de la République informe l’autorité compétente de l’Etat de condamnation de ces faits et de l’impossibilité pour les autorités judiciaires françaises de statuer sur ce cas.
