Article 788 of the French Code of Criminal Procedure

The convicted person must, except in the case of prescription, justify payment of the fine and damages or the remission made to him.

Failing this justification, he must establish that he has undergone the time of judicial constraint determined by law or that the Treasury has waived this means of enforcement.

If he is convicted of fraudulent bankruptcy, he must prove payment of the bankruptcy liabilities in capital, interest and costs or remission thereof.

In the event of joint and several condemnation, the court determines the share of the damages or liabilities that must be paid by the claimant.

If the injured party cannot be found, or if he refuses to receive the sum due, it is paid to the Caisse des dépôts et consignations as in the case of offers of payment and consignment. If the party does not appear within a period of five years to receive the sum consigned, this sum is returned to the depositor on simple request.

Le condamné doit, sauf le cas de prescription, justifier du paiement de l’amende et des dommages-intérêts ou de la remise qui lui en est faite.

A défaut de cette justification, il doit établir qu’il a subi le temps de contrainte judiciaire déterminé par la loi ou que le Trésor a renoncé à ce moyen d’exécution.

S’il est condamné pour banqueroute frauduleuse, il doit justifier du paiement du passif de la faillite en capital, intérêts et frais ou de la remise qui lui en est faite.

En cas de condamnation solidaire, la cour fixe la part des dommages-intérêts ou du passif qui doit être payée par le demandeur.

Si la partie lésée ne peut être retrouvée, ou si elle refuse de recevoir la somme due, celle-ci est versée à la Caisse des dépôts et consignations comme en matière d’offres de paiement et de consignation. Si la partie ne se présente pas dans un délai de cinq ans pour se faire attribuer la somme consignée, cette somme est restituée au déposant sur sa simple demande.
