Article 814 of the French Civil Code

Where the succession has been accepted by at least one heir, either purely and simply or up to the amount of the net assets, the judge who appoints the successoral mandatary pursuant to articles 813-1 and 814-1 may authorise him to carry out all acts of administration of the estate.

He may also authorise him, at any time, to carry out acts of disposal necessary for the proper administration of the estate and to determine the prices and stipulations thereof.

Article 814

Lorsque la succession a été acceptée par au moins un héritier, soit purement et simplement, soit à concurrence de l’actif net, le juge qui désigne le mandataire successoral en application des articles 813-1 et 814-1 peut l’autoriser à effectuer l’ensemble des actes d’administration de la succession.

Il peut également l’autoriser, à tout moment, à réaliser des actes de disposition nécessaires à la bonne administration de la succession et en déterminer les prix et stipulations.
