Article 82-2 of the French Code of Criminal Procedure

When the person under investigation applies to the examining magistrate, pursuant to the provisions of Article 82-1, of a request that this magistrate carry out a transport to the scene, to hear a witness, a civil party or another person under investigation, he or she may request that this act be carried out in the presence of his or her lawyer.

The civil party has this same right with regard to a transport to the scene, the hearing of a witness or another civil party or the questioning of the person under investigation.

The examining magistrate decides on these requests in accordance with the provisions of the second paragraph of Article 82-1. If the request is granted, the investigating judge shall summon the lawyer no later than two working days before the date of the transport, hearing or questioning, during which the latter may take place under the conditions provided for in article 120.

Article 82-2

Lorsque la personne mise en examen saisit le juge d’instruction, en application des dispositions de l’article 82-1, d’une demande tendant à ce que ce magistrat procède à un transport sur les lieux, à l’audition d’un témoin, d’une partie civile ou d’une autre personne mise en examen, elle peut demander que cet acte soit effectué en présence de son avocat.

La partie civile dispose de ce même droit s’agissant d’un transport sur les lieux, de l’audition d’un témoin ou d’une autre partie civile ou de l’interrogatoire de la personne mise en examen.

Le juge d’instruction statue sur ces demandes conformément aux dispositions du deuxième alinéa de l’article 82-1. S’il fait droit à la demande, le juge d’instruction convoque l’avocat au plus tard dans les deux jours ouvrables avant la date du transport, de l’audition ou de l’interrogatoire, au cours desquels celui-ci peut intervenir dans les conditions prévues à l’article 120.
