Article 84-1 of the French Code of Criminal Procedure

During the first appearance of the person under investigation or the first hearing of the civil party or the assisted witness and at any time during the proceedings, the examining magistrate may ask the party, in the presence of his lawyer or the latter duly summoned and after having brought to his attention the article 161-1, if they declare that they waive the benefit of this article.

The person may declare that he or she will waive the benefit of Article 161-1 only for certain categories of expert reports that he or she specifies.

Article 84-1

Lors de la première comparution de la personne mise en examen ou de la première audition de la partie civile ou du témoin assisté et à tout moment au cours de la procédure, le juge d’instruction peut demander à la partie, en présence de son avocat ou celui-ci dûment convoqué et après avoir porté à sa connaissance l’article 161-1, si elle déclare renoncer au bénéfice de cet article.

La personne peut déclarer ne renoncer au bénéfice de l’article 161-1 que pour certaines catégories d’expertises qu’elle précise.
