Article 87 of the French Code of Criminal Procedure

Constitution de partie civile may take place at any time during the investigation.

It may be contested by the public prosecutor or by a party.

In the event of a challenge, or if he declares the civil party constitution inadmissible, the investigating judge shall rule, after communication of the file to the public prosecutor, by reasoned order, which the interested party may appeal.

If a civil party’s claim is contested after the notice of the end of the investigation provided for in Article 175, it may not be examined either by the examining magistrate or, in the event of an appeal, by the investigating chamber, without prejudice to its examination, in the event of referral, by the trial court.

Article 87

La constitution de partie civile peut avoir lieu à tout moment au cours de l’instruction.

Elle peut être contestée par le procureur de la République ou par une partie.

En cas de contestation, ou s’il déclare irrecevable la constitution de partie civile, le juge d’instruction statue, après communication du dossier au ministère public, par ordonnance motivée dont l’intéressé peut interjeter appel.

Si la contestation d’une constitution de partie civile est formée après l’envoi de l’avis de fin d’information prévu à l’article 175, elle ne peut être examinée ni par le juge d’instruction, ni, en cas d’appel, par la chambre de l’instruction, sans préjudice de son examen, en cas de renvoi, par la juridiction de jugement.
