Article 874 of the French Code of civil procedure

The President of the Commercial Court is seised by petition in the cases specified by law.

The parties are exempted from the obligation to constitute a lawyer in matters of pledge of stocks and pledge without dispossession.

In these matters, the parties may present their application themselves.

They may be assisted by a lawyer.
They may be assisted or represented by any person of their choice.
If the representative is not a lawyer, he or she must hold a special power of attorney.

Le président du tribunal de commerce est saisi par requête dans les cas spécifiés par la loi.


Les parties sont dispensées de l’obligation de constituer avocat en matière de gage des stocks et de gage sans dépossession.


En cette matière, les parties peuvent présenter elles-mêmes leur requête.


Elles ont la faculté de se faire assister ou représenter par toute personne de leur choix.


Le représentant, s’il n’est avocat, doit justifier d’un pouvoir spécial.
