Article 88-2 of the French Code of Criminal Procedure

The investigating judge may, in the course of the proceedings, order the civil party requesting an expert opinion to first pay a supplement to the deposit provided for by Article 88 in order to guarantee payment of the costs likely to be charged to him pursuant to the second paragraph of Article 800-1. This decision is made by a reasoned order that may be appealed to the Investigating Chamber. It may also be taken by the investigating chamber seized after the investigating judge has refused to order the requested expert opinion.

The additional deposit is returned if the second paragraph of article 800-1 is not applied.

Article 88-2

Le juge d’instruction peut, en cours de procédure, ordonner à la partie civile qui demande la réalisation d’une expertise de verser préalablement un complément de la consignation prévue par l’article 88 afin de garantir le paiement des frais susceptibles d’être mis à sa charge en application du second alinéa de l’article 800-1. Cette décision est prise par ordonnance motivée susceptible d’appel devant la chambre de l’instruction. Elle peut également être prise par la chambre de l’instruction saisie après que le juge d’instruction a refusé d’ordonner l’expertise demandée.

Le complément de consignation est restitué s’il n’est pas fait application du second alinéa de l’article 800-1.
