Article 888 of the French Code of civil procedure

If conciliation cannot be reached, or if one of the parties fails to appear, the case shall be referred for trial at a hearing, the date of which shall be indicated by the Chairman to the parties present.

Parties who have not been notified orally shall be summoned in the manner and within the time limits provided for in Article 886. The summons states that if they fail to appear, they risk judgment being handed down against them based solely on the evidence provided by their opponent.

A défaut de conciliation, ou en cas de non-comparution de l’une des parties, l’affaire est renvoyée pour être jugée à une audience dont le président indique la date aux parties présentes.


Les parties qui n’ont pas été avisées verbalement seront convoquées dans les formes et délais prévus à l’article 886. La convocation indique que faute pour elles de comparaître, elles s’exposent à ce qu’un jugement soit rendu contre elles sur les seuls éléments fournis par leur adversaire.
