Article 89 of the French Civil Code

The application is presented to the judicial court of the place of death or disappearance, if this occurred in a territory under the authority of France, otherwise to the court of the domicile or last residence of the deceased or disappeared person or, failing this, to the court of the place of the home port of the aircraft or vessel that was transporting him or her. Failing any other, the judicial court of Paris has jurisdiction.

If several persons have disappeared in the course of the same event, a collective application may be presented to the court of the place of disappearance, to that of the home port of the vessel or aircraft, to the judicial court of Paris or to any other judicial court that the interests of the case justify.

La requête est présentée au tribunal judiciaire du lieu de la mort ou de la disparition, si celle-ci s’est produite sur un territoire relevant de l’autorité de la France, sinon au tribunal du domicile ou de la dernière résidence du défunt ou du disparu ou, à défaut, au tribunal du lieu du port d’attache de l’aéronef ou du bâtiment qui le transportait. A défaut de tout autre, le tribunal judiciaire de Paris est compétent.

Si plusieurs personnes ont disparu au cours du même événement, une requête collective peut être présentée au tribunal du lieu de la disparition, à celui du port d’attache du bâtiment ou de l’aéronef, au tribunal judiciaire de Paris ou à tout autre tribunal judiciaire que l’intérêt de la cause justifie.
