The award of direct allocations is subject to the provisions of Commission Regulation (EU) No 651/2014 of 17 June 2014 declaring certain categories of aid compatible with the internal market in application of Articles 107 and 108 of the Treaty, in particular those provided for in Chapter I and Article 54 of Section 11 relating to aid schemes for audiovisual works.
Cinematographic works for which a direct allocation has been granted may, by decision of the President of the Centre national du cinéma et de l’image animée, be considered as works that are difficult in terms of their distribution and marketing conditions when the exceptional circumstances of the covid-19 crisis significantly affect their economic prospects. To this end, the applicant must demonstrate at least one of the following criteria:
1° The work is encountering serious difficulties with regard to its subsequent distribution through the various modes of exhibition, including theatrical exhibition;
2° The work is encountering particular exhibition difficulties likely to have a negative impact on the distribution of other works for which the company holds marketing mandates;
3° The work encounters real difficulties resulting from the costs of its immobilisation and the need to revise the related contracts due to the extended duration of the application of the measure banning admission to cinemas.
Notwithstanding articles 221-5 and 221-6, the intensity of public aid granted for the distribution of these works may be increased to 100% of distribution costs.
