Article 92 of the French Civil Code

If the person whose death has been judicially declared reappears after the declaratory judgment, the Public Prosecutor or any interested party may prosecute, in the forms provided for in Articles 89 et seq, for the judgment to be set aside.

The provisions of articles 130, 131 and 132 shall apply, as appropriate.

Mention of the annulment of the declaratory judgment will be made in the margin of its transcription.

Article 92

Si celui dont le décès a été judiciairement déclaré reparaît postérieurement au jugement déclaratif, le procureur de la République ou tout intéressé peut poursuivre, dans les formes prévues aux articles 89 et suivants, l’annulation du jugement.

Les dispositions des articles 130, 131 et 132 sont applicables, en tant que de besoin.

Mention de l’annulation du jugement déclaratif sera faite en marge de sa transcription.
