Article 923 of the French Code of civil procedure

On the day of the hearing, the chairman ensures that sufficient time has elapsed since the summons was issued to allow the party summoned to prepare its defence. If necessary, he orders that it be reassigned.

If the respondent has instructed counsel, the proceedings shall take place immediately or at the next hearing, depending on the state of the case.

If the respondent has not constituted a lawyer, the court shall rule by judgment deemed to be contradictory, relying, if necessary, on the pleas in law of the first instance.

Le jour de l’audience, le président s’assure qu’il s’est écoulé un temps suffisant depuis l’assignation pour que la partie assignée ait pu préparer sa défense. Le cas échéant, il ordonne sa réassignation.

Si l’intimé a constitué avocat, les débats ont lieu sur-le-champ ou à la plus prochaine audience, en l’état où l’affaire se trouve.

Si l’intimé n’a pas constitué avocat, la cour statue par arrêt réputé contradictoire en se fondant, au besoin, sur les moyens de première instance.
