For the application of article 398, the correctional court is always composed of the president or a judge of the court of first instance.

Articles L. 952-6 and L. 952-7 of the Code of Judicial Organisation relating to the replacement of these magistrates and to the specific procedures for exercising jurisdictional functions are applicable to the criminal court.

Pour l’application de l’article 398, le tribunal correctionnel est toujours composé du président ou d’un juge du tribunal de première instance.
