Article 936 of the French Code of Criminal Procedure

The adversarial hearings held pursuant to article 396 by the liberty and custody judge of the judicial court of Basse-Terre for defendants in the community of Saint-Martin may be carried out by means of audiovisual telecommunication, in accordance with Article 706-71. The provisions of the fourth and fifth paragraphs of this article then apply.

A copy of the pre-trial detention order issued pursuant to the third paragraph of article 396 is sent immediately, by fax or by electronic means of communication, for notification and delivery to the accused and for enforcement of the detention order.

Les débats contradictoires tenus en application de l’article 396 par le juge des libertés et de la détention du tribunal judiciaire de Basse-Terre pour les prévenus se trouvant dans la collectivité de Saint-Martin peuvent être réalisés par l’intermédiaire d’un moyen de télécommunication audiovisuelle, conformément à l’article 706-71. Les dispositions des quatrième et cinquième alinéas de cet article sont alors applicables.

Copie de l’ordonnance de placement en détention provisoire prise en application du troisième alinéa de l’article 396 est adressée sur-le-champ, par télécopie ou par l’intermédiaire d’un moyen de communication électronique, pour notification et remise au prévenu et pour mise à exécution du titre de détention.
