Article A134-2 of the French Commercial code

In support of his declaration, the applicant shall submit:

I. In all cases, a copy of the written document signed with a principal, mentioning the content of the agency contract, or, failing that, any document establishing the existence of such a contract, translated, where applicable, into the French language; and, in addition,

II. For natural persons:

1° The documents relating to identification mentioned in 1. 1, and where applicable 1. 2 and 1. 4. of Annex I of Annex 1-1 to this book;

2° A bulletin or application for affiliation to an old-age insurance fund for non-salaried persons and a bulletin or application for affiliation to a family allowance fund;

3° The certificate of issue of the information, given in accordance with article R. 134-5 to his or her spouse with joint property on the consequences of debts contracted in the exercise of his or her profession on joint property, drawn up in accordance with the model shown in Annex 1-2 to this book;

III. For legal entities:

1° An extract from the trade and companies register dating back less than three months;

2° For directors, as appropriate, the documents referred to in 1. 2. 1, 1. 2. 2, 1. 2. 4, 1. 2. 5, 1. 2. 6, 1. 2. 7 of Annex III of Annex 1-1 to this book;

3° For the persons mentioned in 2° above, a bulletin or application for affiliation to an old-age insurance fund for non-salaried or salaried employees and, for the company, a bulletin or application for affiliation to a family allowance fund.

A l’appui de sa déclaration, le requérant présente :

I. Dans tous les cas, un exemplaire de l’écrit signé avec un mandant, mentionnant le contenu du contrat d’agence, ou, à défaut, tout document établissant l’existence d’un tel contrat, traduit, le cas échéant, en langue française ; et, en outre,

II. Pour les personnes physiques :

1° Les documents relatifs à l’identification mentionnés aux 1. 1, et le cas échéant aux 1. 2 et 1. 4. de l’annexe I de l’annexe 1-1 au présent livre ;

2° Un bulletin ou une demande d’affiliation à une caisse d’assurance vieillesse de non-salariés et un bulletin ou une demande d’affiliation à une caisse d’allocations familiales ;

3° L’attestation de délivrance de l’information, donnée conformément à l’article R. 134-5 à son conjoint commun en biens sur les conséquences des dettes contractées dans l’exercice de sa profession sur les biens communs, établie conformément au modèle figurant à l’annexe 1-2 au présent livre ;

III. Pour les personnes morales :

1° Un extrait du registre du commerce et des sociétés datant de moins de trois mois ;

2° Pour les dirigeants, selon le cas, les documents mentionnés aux 1. 2. 1, 1. 2. 2, 1. 2. 4, 1. 2. 5, 1. 2. 6, 1. 2. 7 de l’annexe III de l’annexe 1-1 au présent livre ;

3° Pour les personnes mentionnées au 2° ci-dessus, un bulletin ou une demande d’affiliation à une caisse d’assurance vieillesse de non-salariés ou de salariés et, pour la société, un bulletin ou une demande d’affiliation à une caisse d’allocations familiales.
