Pursuant to Article L. 341-4, the Autorité de contrôle prudentiel et de résolution may authorise an undertaking to derogate from the provisions defined pursuant to the last paragraph of Article R. 343-3 and Article R. 343-7, in the following cases:
1° When the undertaking requests, for the purposes of determining the provision for claims payable provided for in 4° of Article R. 343-7, to use statistical methods for estimating claims incurred during the last two financial years. The Autorité de contrôle prudentiel et de résolution gives its agreement if the methods are likely to give reliable results in the light of the data available;
2° Where the undertaking estimates that the cost of claims not yet incurred, as referred to in 4° of Article R. 343-7, is lower than the amount resulting from the application of the method defined pursuant to the last paragraph of Article R. 343-7, and requests that its estimate be retained. The Autorité de contrôle prudentiel et de résolution authorises the undertaking to retain its own estimate of the cost of claims not yet reported, if it considers that this estimate is based on sufficient information and a reliable statistical method;
3° When the undertaking can justify, due to a recent and significant change in past claims experience or pricing, that the calculation of the provision for outstanding risk defined in 3° of Article R. 343-7 leads to an overestimation of its amount and it requests that some of the calculation parameters be changed. The Autorité de contrôle prudentiel et de résolution will authorise these changes if the undertaking is able to provide appropriate justification;
4° When the undertaking requests an estimate of the future rate of return on assets allocated to technical commitments, in order to assess the provision for financial contingencies provided for in 5° of Article R. 343-3. The Autorité de contrôle prudentiel et de résolution authorises the use of this rate if it considers that the estimate is based on sufficient information and on a reliable and prudent method.
