Article A356-3 of the French Insurance Code

In accordance with article R. 356-17, when an undertaking mentioned in the first paragraph of article R. 356-8 is a participating undertaking of a credit institution, an investment firm or a financial institution, that undertaking applies, for the calculation of the group’s solvency, the accounting consolidation method, known as method No. 1, defined in Article 9 of the Order of 3 November 2014 on the supplementary supervision of financial conglomerates or the deduction and aggregation method, known as method No. 2, defined in Article 10 of that same Order.

However, method no. 1 is applied only when the Autorité de contrôle prudentiel et de résolution as group supervisor is satisfied with the level of integration of the management and internal control of the entities that would fall within the scope of consolidation.

Article A356-3

Conformément à l’article R. 356-17, lorsqu’une entreprise mentionnée au premier alinéa de l’article R. 356-8 est d’entreprise participante d’un établissement de crédit, d’une entreprise d’investissement ou d’un établissement financier, cette entreprise applique, pour le calcul de la solvabilité du groupe, la méthode de la consolidation comptable, dite méthode n° 1, définie à l’article 9 de l’arrêté du 3 novembre 2014 relatif à la surveillance complémentaire des conglomérats financiers ou la méthode de déduction et agrégation, dite méthode n° 2, définie à l’article 10 de ce même arrêté.

Toutefois, la méthode n° 1 n’est appliquée que lorsque l’Autorité de contrôle prudentiel et de résolution en tant que contrôleur du groupe est satisfaite du niveau d’intégration de la gestion et du contrôle interne des entités qui relèveraient de la consolidation.
