Article A444-127 of the French Commercial code

Anti-securitisation and suretyship by separate deed (numbers 110 and 111 of table 5) give rise to the collection of:

1° Where the antisecuritisation or suretyship is granted by a third party in the main deed : to a quarter of the emoluments of the main deed;

2° Where there is no main deed: to the emoluments that would have been charged on that deed;

3° In cases other than those provided for in 1° and 2°: to half the emoluments of the main deed.

L’antichrèse et le cautionnement par acte séparé (numéros 110 et 111 du tableau 5) donnent lieu à la perception :


1° Lorsque l’antichrèse ou le cautionnement est consenti par un tiers dans l’acte principal : au quart des émoluments de l’acte principal ;


2° Lorsqu’il n’y a pas d’acte principal : aux émoluments qui auraient été perçus sur cet acte ;


3° Dans les autres cas que ceux prévus aux 1° et 2° : à la moitié des émoluments de l’acte principal.
