Article A512-5 of the French Insurance Code

The amount of the financial guarantee referred to in article R. 512-15 must be at least equal to the sum of 115,000 euros and may not be less than twice the average monthly amount of funds collected by the intermediary, calculated on the basis of funds collected over the last twelve months preceding the month of the date of subscription or renewal of the guarantee undertaking.

In calculating the amount of the guarantee, account is taken of the total funds collected by the intermediary and entrusted to him by policyholders for payment to insurance companies or by any natural or legal person for payment to policyholders. Payments for which the intermediary has received a written mandate from an insurance company expressly entrusting him with the collection of premiums and, incidentally, the settlement of claims, will be deducted from this total.

Le montant de la garantie financière mentionnée à l’article R. 512-15 doit être au moins égal à la somme de 115 000 euros et ne peut être inférieur au double du montant moyen mensuel des fonds encaissés par l’intermédiaire, calculé sur la base des fonds encaissés au cours des douze derniers mois précédant le mois de la date de souscription ou de reconduction de l’engagement de caution.

Pour son calcul, le montant de la garantie tient compte du total des fonds encaissés par l’intermédiaire et qui lui ont été confiés par les assurés en vue d’être versés à des entreprises d’assurance ou par toute personne physique ou morale en vue d’être versés aux assurés. De ce total seront déduits les versements pour lesquels l’intermédiaire a reçu d’une entreprise d’assurance un mandat écrit le chargeant expressément de l’encaissement des primes et accessoirement du règlement des sinistres.
