Article A761-1 of the French Commercial code

The standard application file for classification as a market of national interest contains, in addition to the deliberation of the regional council concerned, the following documents:

1° The deliberation of the territorial authority or public establishment for inter-municipal cooperation requesting the establishment of the market of national interest on its territory and deciding on the method of development and management of the said market;

2° In the event that the said authority or establishment chooses to delegate the development or management, or the development and management, of the market to a legal entity, it attaches to the dossier the consultation regulations, the specifications setting out the rights and obligations of the future delegatee and, in particular, its method of remuneration;

3° An economic and financial report including a financing plan and a viability study of the site with a provisional balance sheet;

4° A description of the site with regard, in particular, to its compatibility with the town planning documents in force;

5° A location plan of the market showing, in particular, the road and rail links.

The dossier is sent to the regional prefect, who forwards it to the relevant ministers with his opinion.

Le dossier type de demande de classement en marché d’intérêt national contient, outre la délibération du conseil régional intéressé, les pièces suivantes :

1° La délibération de la collectivité territoriale ou de l’établissement public de coopération intercommunale requérant l’implantation du marché d’intérêt national sur son territoire et décidant du mode d’aménagement et de gestion dudit marché ;

2° Dans le cas où ladite collectivité ou établissement choisit de déléguer l’aménagement ou la gestion, ou l’aménagement et la gestion, du marché à une personne morale, elle joint au dossier le règlement de consultation, le cahier des charges fixant les droits et obligations du futur délégataire et, notamment, son mode de rémunération ;

3° Un rapport économique et financier intégrant un plan de financement et une étude de viabilité du site avec un bilan prévisionnel ;

4° Un descriptif du site au regard, notamment, de sa compatibilité avec les documents d’urbanisme en vigueur ;

5° Un plan de localisation du marché laissant apparaître, notamment, les dessertes routières et ferroviaires.

Le dossier est adressé au préfet de région, qui le transmet aux ministres de tutelle avec son avis.
