Article ANNEXE, art. 29 of the French Code of civil procedure

Where an entry has been registered even though it was inadmissible because an essential condition was missing, the court in charge of the register may strike it off ex officio.

It must inform the interested person of the proposed striking off and allow him a suitable period in which to make his objections. An order rejecting such objections may only be appealed immediately.

Lorsqu’une inscription a été enregistrée bien qu’elle ne fût pas admissible parce qu’une condition essentielle faisait défaut, le tribunal chargé du registre peut la rayer d’office.

Il doit informer la personne intéressée de la radiation envisagée et lui impartir un délai convenable pour faire valoir ses objections. L’ordonnance qui repousse ces objections ne peut être frappée que d’un pourvoi immédiat.
